The crucial distinction in Queensland is between two separate approvals:
- Development approval (planning): needed where the planning scheme requires it (a use or siting that is assessable). Many straightforward houses on a standard lot do not need one.
- Building approval (building): needed for essentially all building work, regardless of whether a planning DA was required. A private building certifier assesses the plans against the NCC, the Queensland siting/amenity provisions, and the standards, then issues the BA with conditions.
So a typical new house on a compliant lot may need no planning DA but always needs a building approval before work starts. The certifier also does the mandatory inspections through the build and issues the final certificate/Form 21 at completion.
For a builder the practical points are: never confuse “no DA required” with “no approval required”, the building approval is separate and almost always needed. Engage a building certifier early, get the BA issued before commencing (starting building work without it is an offence and risks an enforcement notice), and book the certifier’s inspection stages into the program. Siting issues (boundary setbacks, site cover) that are not a full planning DA are often handled by the certifier or via a siting concession, so raise them at BA stage.
